SB1 Medical Liability Tort Reform
Kentucky is facing a medical liability insurance crisis that is threatening to reduce Kentuckians’ access to quality care. Physicians are leaving Kentucky for states with less onerous laws. Physicians are discontinuing obstetrics practice leaving women in a number of communities without doctors. Two Kentucky hospitals have had to close their obstetrics units. Physicians are retiring because of huge increases in premiums. A recent study showed that hospitals in Kentucky are paying double the percentage of the average U.S. hospital cost for medical liability insurance. Excessive dollars spent for medical liability insurance means less money for patient care, equipment and staffing.

Senate Bill 1 would make it possible for Kentuckians to vote for or against a Constitutional Amendment that would allow Kentucky legislators to consider tort reform related to medical liability. No rules would change as a result of this bill, it would merely allow the voters to decide whether the legislature would have the legal ability to consider changes. The bill passed the Senate and is now languishing in the House of Representatives. It is Norton Healthcare's position that voters should be able to determine if the legislature can study and debate solutions to this issue. Please contact your representative to express your opinion.
